In order for you to enjoy your Cozy Moose Maine vacation free from unexpected surprises or misunderstandings, it is important that you read and agree to all terms and conditions before making reservations. Please print this lease agreement out and contact us to make reservations. Simply fill in reservation number confirming rental unit, arrival, departure, occupants and vehicle information, deposit paid and any balance due. PROPERTY RENTAL BETWEEN COZY MOOSE AND RENTER IS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS

1. RENT: 50% deposit required to book prior to 30 days of arrival. The remaining 50% is due at check in; however, all summer and winter reservations require balance be paid at least 30 days prior to arrival. Payment in full is required for dates reserved within a 30 day period of arrival.
   
   
2. CANCELLATIONS: This agreement and tenancy created may be terminated providing notice is given 90 day period prior to arrival date. The 50% deposit collected will be refunded less a $75 cancellation fee. There is no guarantee that monies will be refunded or a credit will be issued for cancellations or occupancy changes made within the 90 day period. Any cancellations made within 90 days of arrival will be opened up to re-rent. If re-rented, a lodging credit will be issued for the re-rented rate minus the $75 cancellation fee. We do look at each case on an individual basis and try to re-rent or issue a credit if possible. Note: This does not limit the owners right to give shorter notice as permitted by law.
   
   
3. NO SMOKING AND NO PETS: No smoking inside the cabins or doorways and no pets are permitted anywhere. Any signs or smells of smoking or pets after your departure will automatically result in a cleaning and deodorizing fee of a minimum of $250.00. Dispose all cigarette and cigar butts in receptacles provided. Butts found on property are considered trash and you will be asked to pick them up.
   
   
4. CREDIT CARD DEPOSIT: The renter will supply a valid credit card number to be used as a security deposit. Renter understands and expressly accepts that the Cozy Moose has the right to charge for any damage in excess of reasonable wear and tear to the extent of the cost of the repairs or replacement of missing items. Renter also understands that he/she is expected to leave the property in the condition it was in when he/she arrived. This includes returning items to their place of origin and keeping the outside premises clean and free of trash. The Cozy Moose has the right to charge the renter additional fees if the property requires additional cleaning of excessive messes, outside trash removal including butts, lost key and lock replacement fee and if other conditions in this agreement are not met. Renter agrees that credit card charges that comply with the terms of this agreement are final.
   
   
5. CHECK IN: The office is open for check-in from 3pm to 6pm Monday - Saturday. Sunday by appointment only. Key pick up is not an option. We personally meet and greet all guests - Plan accordingly. Any balances due must be paid at check in.
   
   
6. CHECK OUT: Before 10am. Check outs after 10am will be subject to late fees. Housekeeping arrives at 9:30 am to prepare the Cabins for next check-in, at 3pm that day. It is not possible to accommodate late check-outs. If keys are not returned as directed, a locksmith fee will be charged for key and lock replacement.
   
   
7. OCCUPANCY/GUESTS/VEHICLES: Only the persons named and number of occupants and vehicles denoted in the agreement are to be on the premises. Renter’s rental rates are based on occupancy / bedroom use and confirmed in the agreement. Use of extra beds will result in a linen green fee of $20. Occupancy standards must be strictly adhered to and shall not exceed occupancy standards permitted. All occupants vehicles on the property are confirmed at check in. Any changes in occupancy or visitors must be reported to the office. Any unreported vehicles or occupants on the premises will be considered a violation of occupancy standards and will be required to vacate the property immediately without refund.
   
   
8. PARKING: Renter shall park vehicles, trailers and recreational vehicles in assigned parking. Only registered vehicles are permitted on premises.
   
   
9. RECREATIONAL RENTALS: Boats, canoes, kayaks, and snowmobile rentals are not included in lodging fees unless specified. Use of equipment without a rental agreement will be charged a rental fee. Sorry, no refunds for rental equipment prior to 30 days of reservation.
   
   
10. PROPERTY USE AGREEMENT: If you bring your own boats, snowmobiles or other recreational vehicles, we are not liable for injuries, damages or theft. Docking is at your own risk. No operation or parking of any recreational vehicles is permitted between Cabins, under porches or decks of Cabins. Operation of recreational vehicles is only permitted for access to trails and Lake in plowed parking areas only. Observe the 15 mph speed limit while operating any motorized vehicle on the private access road. Respect your neighbor's property and their privacy. DO NOT TRESPASS ON THEIR LAND! We will not tolerate complaints by others for disrespectful activity. QUITE HOURS- observed before 8am and after 10pm.
    
    
11. HEAT/UTILITIES/REFUNDS: Heat and utilities included, all equipment is maintained and serviced. There will be no refunds if failure should occur or service be interrupted. No refunds will be made for inclement weather or for early departures.
    
    
12. GAS FIREPLACES: Gas log fireplaces are serviced and inspected by a trained technician. Do not set anything on top or make any adjustments to the gas log fireplaces other than the thermostat control on the wall; otherwise a service fee will apply. Note: Fireplaces are turned off during the summer season
    
    
13. ENTRY/INSPECTION: If required, the Cozy Moose reserves the right to service, inspect or make repairs. Rental cabins may be serviced if upkeep is needed.
    
    
14. ELECTRICAL: No electrical outside hookups are allowed of any kind. (i.e., campers, trailers, etc.) Do not move or disconnect inside electronics as a service fee may apply.
    
    
15. LAKE / TRAIL ACCESS: Use at your own risk. You are responsible to check ice conditions when snowmobiling or ice fishing. Please exercise extreme caution. Watch out for protruding rocks that may appear to be snow. Do not access the Lake through other people's property. Refer to access information provided at check in. Observe the 15 mph speed limit while in neighborhood.
    
    
16. WATERFRONT: The Cozy Moose beach, boat dock, and outside grounds are common area to all lodging guests and may be serviced if upkeep is needed.
    
    
17. BE GREEN/RECYCLING/ TRASH: You agree to recycle otherwise it is Carry In - Carry Out. You must recycle cans, bottles, 1 and 2, plastics, newspapers and cardboard in containers provided. All household trash is to be bagged and will be picked up at the end of your stay or when property is being serviced. If your trash contains recycle materials in it, you will be charged a green fee to dispose. No hazardous waste of any kind is to be left. Double bag all diapers. If you choose not to recycle, then it is Carry In, Carry Out. Thank You.
    
    
18. SEPTIC SYSTEMS: Use septic safe toilet paper. All other products are to be put in trash. Put grease in sealed containers, bagged and dispose in household trash. Never dumped outside or down sinks. No garbage of any kind is to be put down sinks. Thank You
    
    
19. INDEMNIFICATION: The Cozy Moose is not liable for personal injuries. Any unsafe or dangerous condition must be reported to us immediately. For children's safety, they are to be supervised at all times. Renter agrees to hold The Cozy Moose harmless for any and all loss of or damage to your personal property, injury or death resulting from the use of the rental property, grounds, boat dock, and/or beach. Caution: No diving is permitted off dock. Swim at your own risk.
    
    
20. OUTSIDE GROUNDS/GAS GRILLS: Sorry, no outside campfires, charcoal fires, fireworks or firearms, BB guns, air rifles, or sling shots are permitted on premises. Gas grills are provided as a seasonal amenity for outdoor cooking. Grills are to remain in grilling area off decks. Outside grounds and grills are to be kept clean the way you found them. If gas grills require cleaning after your departure, you will be charged a minimum of $45.00 grill cleaning fee, so please clean the grill and turn off gas valve after use. You are responsible for gas used during your stay. For your safety, please do not cook bacon on grills or use excessive oil for this can be a fire hazard.
    
    
21. UNLAWFUL ACTIVITY: Renter agrees not to violate any local, county, or federal laws during rental period. This includes removing vegetation, cutting trees, branches or bushes on the property as to not violate shore land zoning regulations.
    
    
22. DISPUTES: In the event of any legal dispute concerning this agreement, the parties elect the jurisdiction of civil courts of the Cozy Moose.
    
    
23. TERMINATION/DEFAULT/ VIOLATIONS: This is a short term transient rental agreement and does not acquire tenant status rights. Violations by guests of the general guidelines stated above without a signed acknowledgment from The Cozy Moose will be grounds for eviction without entitlement to prior notice and result in no refund. Cozy Moose reserves the right to cancel any reservation made under false pretenses and has the right to refuse or discontinue rental agreement if it is in the opinion that the renter is detrimental to the property.
    

24. THE TERMS AND CONDITIONS OF THE LODGING PROPERTY IS STATED IN THIS AGREEMENT. THIS IS AN UNDERSTANDING BETWEEN LESSEE AND LESSOR FOR LODGING ACCOMMODATIONS AND RECREATIONAL DEPOSITS. IT IS UNDERSTOOD THAT A SEPARATE LEASE FOR RECREATIONAL RENTALS IS REQUIRED.
    
    
    
    
    
    I AGREE TO PROPERTY TERMS 1 THROUGH 24 AND UNDERSTAND THEM. I AGREE THAT I WILL ENSURE MEMBERS IN MY PARTY ABIDES BY THE TERMS SET FORTH. A SIGNED COPY OF THIS AGREEMENT SHALL HAVE THE SAME FORCE AND EFFECT AS AN ORIGINAL.
